Terms & Conditions

Please read these terms carefully before using SMJobs.

Last updated: 21 October 2026 · Version 1.0

1. Acceptance of Terms

By accessing or using SMJobs ("the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Platform. If you do not agree to the Privacy Notice or the Cookie Policy, you must tell us before you give us any personal information.

2. Who we are and description of the service

The Platform is operated by [LEGAL ENTITY NAME] ("SMJobs", "we", "our", "us"), a company registered in South Africa with registration number [CIPC REGISTRATION NUMBER], of [REGISTERED STREET ADDRESS] (VAT number [VAT NUMBER]).

SMJobs is a South African online job platform that connects job seekers with employers. We provide a marketplace for job listings, candidate profiles, and related recruitment services. We are an intermediary between employers and job seekers: we host the listings and the profiles, we do not guarantee that any listing is genuine or that any candidate is suitable.

3. Your personal information and POPIA

We process your personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA"). The Privacy Notice explains what we collect, why we collect it, who we share it with, how long we keep it, and the rights you have over it. It forms part of these Terms, and if there is any inconsistency between the two, the Privacy Notice governs the handling of personal information.

Where we ask for your consent, you give it freely and you can withdraw it at any time. A few things in particular:

  • When you apply for a job, you confirm that we may process your name, contact details, CV and covering letter and pass them to the employer you applied to.
  • When you sign up, you confirm that you have read and accept these Terms and the Privacy Notice.
  • Optional cookies and similar technologies, including Google AdSense advertising, only work if you agree to them, and you can change your mind at any time using the "Cookie settings" button in the footer of any page.
  • You decide for yourself whether your profile appears in the talent directory. It is switched off when you register, and only appears once you switch it on.

You have the right to ask us for a copy of the personal information we hold about you, to have it corrected or deleted, to object to how we use it, and to complain to the Information Regulator of South Africa. See section 12 of the Privacy Notice, or contact our Information Officer at info@smjobs.co.za. The PAIA & POPIA Compliance Manual sets out the full processing register and the procedure we follow for each of those rights.

4. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must be at least 18 years old to register. Tell us promptly if you believe someone else has used your account, and change your password if you think it has been exposed.

5. Job Seeker Responsibilities

  • You must provide accurate, truthful information in your profile and applications.
  • You may not misrepresent your identity, qualifications, or experience.
  • You agree not to use the Platform for any unlawful or prohibited purpose.
  • You are responsible for the lawfulness of what you upload. Do not upload content you do not have the right to share, and do not include special personal information (health, religious or political belief, racial or ethnic origin) in your CV unless the employer needs it for the role and you have agreed to that.

6. Employer Responsibilities

  • Employers must provide accurate information about their organisation and job listings.
  • Job listings must comply with all applicable South African labour laws, including the Employment Equity Act and the Basic Conditions of Employment Act.
  • Employer accounts are subject to review and approval by SMJobs.
  • An employer may only use the personal information of a job seeker who has applied to them, or who has chosen to appear in the talent directory, and only for recruitment purposes relating to that seeker. You may not scrape, harvest or resell the candidate database, or contact job seekers for unrelated marketing.
  • You are a responsible party in your own right for the personal information you collect from candidates through the Platform, and you are responsible for your own compliance with POPIA.

7. Prohibited Conduct

You agree not to engage in any of the following: (a) posting false, misleading, or fraudulent job listings; (b) collecting user data without consent; (c) transmitting malware or harmful code; (d) interfering with the Platform's operation; (e) violating any applicable laws or regulations, including POPIA; (f) using automated tools to scrape the Platform or submit applications on another person's behalf.

8. Intellectual Property

All content on the Platform, including logos, design, text, and software, is the property of SMJobs or its licencers and is protected by South African and international copyright laws. A CV or profile you upload remains yours; by uploading it you give us a non-exclusive licence to store it, to display it to the employer you applied to, and to display it in the talent directory if you have switched that on, for as long as we keep it under the retention periods in the Privacy Notice.

9. Limitation of Liability

SMJobs acts as an intermediary and does not guarantee the accuracy of job listings or the suitability of candidates. To the maximum extent permitted by law, SMJobs shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Nothing in these Terms limits your right to lodge a complaint with the Information Regulator, or takes away any right you have under POPIA.

10. Termination and account deletion

We reserve the right to suspend or terminate accounts that violate these terms or engage in prohibited conduct, without prior notice. You may delete your account at any time using the "Delete my account" control on your account page. When you do, we remove your profile, CV file, profile photograph, applications, saved jobs, consent records and password-reset tokens, and we stop sending you email. We will keep only what the law requires us to keep, and we will tell you if that applies.

11. Changes to Terms

We may update these terms from time to time. We will update the "Last updated" date and version number at the top of this page. Continued use of the Platform after a change constitutes acceptance of the updated terms. Where a change affects the way we use your personal information, we will ask you again for consent before the new use begins.

12. Governing law, and complaints

These terms are governed by the laws of the Republic of South Africa, and the courts of Gauteng have jurisdiction over any dispute arising from them.

If you have a concern about the Platform, please raise it with us first at info@smjobs.co.za or on +27 788 770 744, so that we can put it right. If you are not satisfied with how we have handled your personal information, you have the right to lodge a complaint with the Information Regulator of South Africa, established under the Protection of Personal Information Act 4 of 2013. You do not have to complain to us first.

13. Contact

If you have questions about these terms, please contact us at info@smjobs.co.za or call +27 788 770 744. Our Information Officer is [INFORMATION OFFICER NAME AND ROLE].
